I've always been of the school of thought that the open air intakes underhood may
eventually heatsoak the IC sooner since you are drawing in hotter air to begin with, but under normal driving conditions its probably negligible (and my data showed that) since its pre-IC.
Not all cause CELs. For example CTS does not, because it has a properly designed MAF housing.
They don't really cause "less performance". Any increase is debatable, but unless you have a really poorly designed intake it shouldnt make your car slower. It may change your throttle response and drivability characteristics.
