Yep, many ECU's have data logging function on them too now, so they can see historical parameters like boost pressure, so not even removable piggy backs are safe. Not that they will check the logs out during routine service, but if engine or turbo goes pop, the ECU gets checked.
Also, I bet a chipped 320D will attract a higher insurance premium than a standard (but still more powerful) 330D.
