Bought CPO'd 3, ASS no worky, 30 days at dealer



Twenty-nine days ago I purchased a CPO'd 2012 328i with 45k miles. The day after taking it home I returned it to the dealer because in the Auto Start Stop feature was not working.

What do I mean by not working? I brake and come to a stop, the engine shuts off, I release the brake and engage the clutch and the Check Engine light illuminates. At this point I have to start the car using the push button.

Sure, I could disable the feature entirely. But this is a CPO'd car and I want the feature to work regardless of if I choose to use it or not.

The service advisor has been keeping me reasonably up to date. They started off by replacing a bunch of sensors but no avail. As of June 8th the latest was that the shop foreman was working with BMW directly to resolve the issue by tracing wires. Sounds like they're hoping to find a loose ground wire or something. No update since.

Good news is they've given me a 328i loaner. About to make my first car payment and I haven't driven it but 20 miles. Damn do I want me own car back.

That sucks. Did you finance through BMWFS? If so, I bet they would cover your first payment, since this issue should have been caught in the CPO inspection.

Unrelated to your issue: AFAIK, those wheels weren't available on the 2012 328i Sport Line, so the previous owner or the dealer likely swapped them. I think those are the orbit grey wheels available on the 2-series and certain 3/4 configs with the M-sport brakes. Anyway, they look great, so lucky you!

I honestly don't know much about the wheels but they have brand new run flats that I'm looking to replace with some MPSS's. It really was the wheel and color combo that did it for me! Wish it didn't have a sunroof, though.

29 days of screwing around without fixing it seems the car may fall under the lemon law (if VA has one) and that would give you a bit of "muscle" to push them. Sorry you're having to go through this.

That's a good question. I first noticed it on the drive home from the dealer. I must have either disabled it or never came to a complete stop during the test drive. California Roll.

Your still under the original manufacturer warranty. Thus you are entitled to all the perks as if the car was purchased new. If you like the car and no other issues have been had, I would complain to BMW FS and get as much money out of them as possible.

On another note, I am surprised they are letting the car sit there so long. Usually the dealer will keep track of in service days so they do not run into the lemon law period.

You're on day 32 now and you're willing to give them until the end of next week because they're telling you they"think" they know what the problem is? What have they been NOTdoing for the last month?

I'd contact BMW and tell them to give you your money back - as in every last penny. That should get somebody's attention. A total of over five weeks sitting in the dealership is ridiculous by any standard.

FREAKING FANTASTIC NEWS!

My SA just called. She said they discovered the problem. Put as simply as I can, the exhaust flap actuator was drawing too much voltage from the battery and not providing enough juice to a clutch component (not sure what she called it).

So a new actuator is ordered and I should have my car back on Monday! Never in my life have I wanted the weekend to pass so quick!

Great news but, I'd still contact BMW and tell them it's been out of service for over a month and they should at least credit you with one payment. After all, providing your state has a Lemon Law, BMW has already gone beyond the time limit.

I did that this morning. They told me they'll evaluate compensation based on the total time I've been without my car after I get my car back. With that, I'm anticipating that they reimburse my first month's payment rather than applying a credit. We'll see.

Do any states have lemon laws that cover used vehicles? I believe the OP is in VA and their statue states:

6/30/15 Update:

Spoke with my service advisor and the shop foreman working on my car. All wires and sensors related to the MSA (BMW's term for ASS) have been traced multiple times. Battery replaced, just about all related modules replaced. The shop foreman makes it sound like they believe the DME is the next to be replaced but because it's A) $2500 and B) Locked to the vehicle after being written, PUMA has been hesitant to give the go-ahead.

While there, I learned something interesting. A handful of 2012 and 2013 N20/26 powered cars are coming back with stretched timing chains. At this point they do not believe BMW is going to issue a TSB or anything but quietly replace without charge. My 328i only has 45k miles and there is noise coming from the front of the engine which the foreman believes to be the timing chain. Also getting the blower motor replaced because it's a bit noisy.
