about the damage on the car i see this 2 ways

1. totalled = loss of downpayment money at worse
2. repaired = car will never have the same value ever again
Here are some of the additional costs and information:
http://www.adp.cahwnet.gov/Criminal_...DUI/faqs.shtml

How much does a DUI Cost?

Costs for DUI have been estimated to be more than $6,600 (actual costs may vary). Here is a conservative itemized breakdown for a first DUI offense:
Fines/Penalties—$1,000
Tow/Impound Fee—215
DUI Treatment Program—626
Court Costs—800
Insurance Increase—500-1,500
Attorney Fees—2,500
Total Approximate Cost:—$6,641

They'll total if the car is structurally unsound too. Years ago, I rolled a midsize SUV on a rainy night and because the a-piller was bent they totalled the car.

We all make mistakes. Some bigger than others. Your wife made a huge one, but luck was on her side this time.

my wife got in an accident with her Audi a few years ago, didn't seem so bad, rear ended someone going about 30 mph, well thats enough to do a lot of engine damage. I think the body shop screwed the insurance company because the car was $32K brand new (2007 Audi, with only a few options) and they said the repairs would be like $14K, so the insurance company said go ahead. well 3 weeks after it was supposed to be finished they gave us the bill, $24,000! and the insurance company kept accepting the increases because $10K of work was already done. Car should be have been classified as totaled to start but the body shop wanted the work so they blew the estimate and the insurance appraiser was too stupid to realize it. Thankfully for us it was a lease, fixed by that Dealerships recommended body shop, so we took no re-sale hit

But if it was totaled we would have received "trade in" value on the car, not retail value or new car value. Unless you have a special insurance clause for full value of the car or your loan then you will only get the trade in value and on a new car that means about a 15% hit from the MSRP!

And driving drunk doesn't help with potentially hurting other irreplaceable people.

I'd be much more PO''d about her driving while drunk, than the damage to the car. The damage just adds to the frustration and aggravation.

It's been said already, the ONLY positive is that no one got physically hurt, or worse.

Don't forget to push the insurance company on recovering the "diminished value" of the vehicle in addition to the cost of the repairs. (the loss in market value that will result from the fact that few people will ever want to buy a car that had $20,000+ in repairs) That can often help push you over the line for a complete total if the repairs don't total it out alone. The insurance company generally will NOT bring this up, you will have to make a claim for it.

My ex crashed her 1 year old 128i pretty badly, the insurance company was insisting on repairing it- once she demanded that they also make her whole for the diminished value, they then totaled it out.
Speaking of insurance, not only are his rates going to go up due to the cost of repair or total, but the rates will SKYROCKET due to his wife's DUI. And on top of that, all the fee's and fines for the DUI.

As a poster already stated, this was completely avoidable.
It's no accident. It's a disaster.

Damn. No wonder the divorce rate is so high. What happened to for better or for worse?

I'd look at it this way, at least he has some chips now that he can cash in whenever he does something she is disappointed about. I mean he has the upper hand. All he has to do is say, "Remember that time you totaled my BRAND NEW BMW? Cut me some slack." That's an awesome position to be in marriage-wise for a guy.

Everyone makes mistakes. There is no excuse for drinking and driving. Don't worry about the car, it's just a piece of metal. I would be seriously pissed too, but the car be replaced. People's lives cannot. Thankfully no one was hurt. Find a good lawyer to at least get the charge reduced to something less - your wife has learned a lesson the hard way.

I'm sorry, that sucks about your car, but this is a really odd place to vent your family's dirty laundry and listen to a bunch of strangers telling you how to treat your wife.

which would be great, if not for the fact that he mentioned the DUI and people have said several times what he should do or say to his wife. Read the posts before you tell me I'm the one that's off topic. It was in his original post, so yours is the only post that's off-topic.

But you're right about one thing, it's a BMW forum, not a place for idiots to tell the guy to beat his wife, "lol" or not.

Ok i think it's time for all of us to enjoy some mint:

Chrisny:

Please understand the sarcasm and the light hearted ambience that reside among the pages of this forum.

OP wanted to vent...
He decided to openly disclose whatever information he choose.
We respect him and so it was fair game to discuss whatever information he wanted to share with us.
we didn't mean to disrespect her as much as she didn't mean to drive drunk.

i really feel sorry for the guy, but what can we do??
we are not blaming him, we are not blaming his choice...

and no matter how much
I am really sorry for whatever happened to any party involved in this matter,
but it was HER choice!

i really fail to see the logic in her choice...
... she has to assume her responsibilities now, and OP has to share it with her...

we are just providing some supports...

BUT:
Do you really think OP is going to carry out what we have told him here??
OP should be smart enough to know that we are just here to help him vent and bring some crude remarks to aliaviate the seriousness of the problem.

Anyhow, harms have been done, let's move on:

I am sorry OP if our remarks have hurt you or your wife or your relationship...
Please forgive us...

Please continue to love your wife as she will be going through some tough times!

Sorry, I wouldn't call telling the guy to beat his wife "light-hearted ambiance" no matter how many lol's follow it. More importantly, I was simply stating my opinion like everyone else, seems like a childish thing to me, to bring what I would consider a serious, family issue, onto a public forum to discuss cars. Can't disagree with any RATIONAL responses upset about her driving drunk, just saying I think it was bad judgement to bring it up here in the first place. It's his wife, his marriage, his prerogative. Just like it's mine to say I thought it was odd, end of story.
