Concur with the above. I got summoned for reckless driving in Fairfax County; anything 20+ over the limit is automatically reckless, and the same grade of misdemeanor as a DUI. I saw a middle-aged woman in court sent to jail for two days for doing 90 in a 55.
Get a lawyer. |

I highly recommend you hire a lawyer. A reckless driving ticket is equivalent in points to a DUI (very serious offense) and your insurance will likely go up (not SR22 crazy like a DUI, but your rates will surely increase).
I received a reckless driving ticket in my wife's Honda Odyssey back in the day (yes, I was speeding in a minivan - lol). I was doing 66 in a 45 (21 over the limit). It happened in New Kent County, VA so I decided to find a lawyer in that area (I live in Chesapeake, VA) so maybe, just maybe the judge would know him. Turns out he did and my lawyer said I'd be fine with such a low speed. In preps for the court date, I completed the AAA Driving Improvement Course on the Navy base where I was stationed and I had my driving record from IL printed out (it was spotless even though I had a few speeding tickets from VA that I had paid. I guess the DMVs don't talk to one another - lol). I figured I was prepped as I could be for "judgment day". The judge looked at everything and said, "faulty equipment" which was a small fine ($30 at the time) plus the court cost. In the end lawyer was $300 and ticket/court cost was $92. That is A LOT LOWER than a reckless ticket fine and having that on your record. It's funny that the lawyer didn't even really do anything during the hearing, but my guess is the judge saw that I knew this was serious and took steps to mitigate the charge. I don't think it would have ended the same way if I just showed up by myself. I hope this works out well for you! |

Hire an attorney.

The OP is lucky he didn't get a ticket for DWHUA, which it appears is what he was really doing. I'd have written him for that when I was in law enforcement. No excuse for that kind of behavior. This is why many people feel that BMW owners have more money than brains, and in some cases, it's justifiably so.

My dad got busted for 90+, and I think it was in VA (he blames his Infiniti G35 ). Good thing I happened to call him after it happened because he was just going to show up in court and wing it. After a lot of arguing I managed to convince him to get a lawyer.
He says court day was pretty weird. He and his lawyer sat around BS'ing in the lawyer's office. He kept asking if they should head over to the court building and the lawyer kept putting him off. Eventually the lawyer gets a phone call and afterwards says, "Ok we're all set, you can go." He ended up with a fine plus lawyers fees of around $500 total, vs the 2k + jail time he'd been looking at. Recently my dad retold the entire story to me as if I'd never heard it, and in his version of the story it was entirely his idea to get a lawyer Oh yeah, a couple years ago I was driving from LA to Phoenix. Cruising along around 90 and totally zoning out which is very unlike me. Anyway a CHP pulled up alongside me and while I was busy freaking out he looks directly at me and wags his finger, then sped off. My wife was in the car and continues to be totally pissed that I somehow always manage to dodge tickets while she never catches a break. Thank God I never drive in VA! |

Yeah I got charged with Reckless in VA back in 2001 before the possible jailtime law became a thing and even then I got a lawyer, mainly because I was ticketed for Reckless because I "broke traction" was even going 10 miles under the speed limit, the road conditions were poor and my tires squealed and still with the BS Charge I had to go to 16 hours of traffic school and part of the plea agreement with the prosecutor to knock it down to Improper Driving.
Now though with the new laws I cannot emphasis enough to the OP and to everyone else. NEVER SPEED IN VIRGINIA IT IS NEVER WORTH IT. |
