MD Complaint sent :)

So the 430d vert i bought as you know had a load of front end damage not in keeping with its 9000 miles it had driven.

The dealer has agreed to completely sand and repaint the whole front end of the car to remove the stone chips and scratches. 1-0

Refused to replace the wipers and disks as they pass AUC 1-1

So now im getting their Managing Director involved in the issue. I wonder if he thinks its ok to replace the wipers on a car less than 9 months old at my own expense and if he thinks this whole experience is what his company should deliver to a customer spending 35 grand on a car.

Lets see what his team comes back with as i dont expect a direct reply (yet)

My car is almost 3 years old, similar mileage and wipers are fine! Have they changed them with older ones?

I had a period when I needed new wipers every 3-4 months. Finally worked out it was because I was leaving the car at the airport every week - I think the aviation fuel in the air knackers them. You car may have been treated the same way.

I always used to park next to this 3 series BMW when I was flying out to Italy etc.

Always took advantage to swap out my shoddy wipers for their new ones

Sadly TFR damages rubber quickly.

The stone chips have been sorted. I would reject if i could get the same spec for this money. But i dont fancy paying 2-3k more for less spec when once this is sorted i will have a brand new condition car plus BMW good will gesture for the trouble!

My wipers needed to be replaced after 2 months on a new car. I don't rate BMW wipers at all, I wouldn't ever consider that as an issue to bring up when rejecting a car.

Surely BMW will simply say that wipers are a consumable item and therefore not something they would replace under warranty. They could blame cleaning chemicals, weather or Brigand at the airport for them needing changed!

The car was driven and owned by BMW AG. So they can blame who ever they like. Its their fault.

They dont really have any defence since any wear is premature and caused by their staff and their prep center didnt pick up anything other than the 4 new alloys. They even rotary burned the bonnet.

Be interesting to see what they say next week. The MD office has emailed back saying they will contact me next week.

BMW have offered a refund which causes me more problems than it solves. It also doesnt solve their problem as ill sue after refund. Which leaves us both in a crap situation.

Their latest offer is a new car with support from dealer and bmw hq. So now im waiting on what they will do in terms of cost. It seems a logical solution for both parties but depends on how much they are willing to knock off the price.

sounds like it could get a bit sticky.

One word of advice though is get everything in writing and any emails you send ask for a reply stating they have received it, and follow up with yet another email if they don't reply.

Yes luckily i have photos and emails.

They are so far being OK about it. i think they are disapointed that the car came to them in this way. They know the small but numerous issues with the car will add up to quite some cost let alone any compensation for the hassle.

They will want this to go away with the minimum of hassle and noise. They have a new car in the spec i want and they know its just a matter of price. They are talking about pre registering it so they can get the book value down on it etc. Dont really care how they get to the cost really just what it is.

It's not a nice situation to be in, but a refund is a fair outcome, a replacement car to the same spec is a fair outcome, a new car would be betterment and I really don't see what grounds you have for suing anyone!
