14' f30 m-SPORT 6MT x-DRIVE 19" ZCP SETUP

Was Wondering If The 359m's Would Fit On My X-drive W/ 235/35r19 - 265/30r19 On The Rears . Keep In Mind I Live In Nyc And The Roads Are Horrible So Rubbing Can Become An Issue If The Setup Is Not Right. Besides That Does This Setup Affect The Drivetrain/transmission In Any Way?

No, the staggered style 359 setup is too aggressive for F30!

OEM style 359:
F: 9x19" ET31
R: 10x19" ET25

Since it is only the rear that is too aggressive one possibillity is to find four fronts and mount a square setup. 235 or 245/35-19 tires all around will work without issues.

The Stock 19" 4009 Come With A Staggered Setup . Are The Rear Rims To Wide In General Or Can I Just Do A 255/35r19 Stretched. Basically Use The Factory Tires From The 409s?

The width in combination with the low offset (10" wide offset 25).

To fit a 10" rear wheel the offset needs to be around 40-45.
