Bad DME on delivery

Here's one for ya. Went to take delivery of my car and it wouldn't start, engine turned over for about 15 seconds and then shut off again. Display showed an error in the "Drivetrain"...3 days later, dealer diagnosed as DME failure. They now have to get approval to order a new one and then install it. As expected, i'm still seriously pissed off....

Any others with the same experience?

So sorry to hear this Z. I would demand a new car. It's just leaves such a bad taste in your mouth when from day 1 the car would not start. :-( Let me know if there is anything I can do.

Whoa. I'm sorry to hear. I would require a loaner at no charge until the DME is installed (assuming they haven't already). Since you need a new DME, make them give you a PPK for the troubles!

Thanx Raja. Don't want to demand a new car just yet. If it happens again a few times, then yea, that's definitely going to be on the table for discussion. I'll get it to you soon enough hopefully!!!

Sadly, since I traveled out of state for the car, they denied me a loaner car. Something about their insurance not covering me if I drove out of the state or something along those lines. I've already taken it up with BMWNA, who said to talk to the dealership.

Doesn't your insurance cover the loaner? I understand that dealers have their insurance, but after all, it's like a rental.

Sorry to hear that but with the loaner, wouldn't that be the same as someone (like myself) who lives in a nearby bordering state, gets their car serviced in one state and drives back home to another in a loaner? I live on the NC/SC border and I am sure I am not slipping through the cracks as there are a lot of people in similar situations.

I would ask the PPK as well or accessories.

I was about to make a statement that based on this and several other posts, I have no respect for the NYC BMW Dealers, but then you stated you purchased it out of state.

With that in mind, wtf....the dealership did not start the car after it came off the truck and during prep, spotting this issue before contacting you that your car was ready for delivery?

Did you sign the papers for the car - and then this happened - or did it happen before you signed the papers.

If you signed papers, they should give you a loaner car. If you do not own it, they have no obligation to give you a loaner car (actually, they have no obligation anyway, though most due).

I would certainly contact BMWNA if you own this car now and buy from another Dealership considering the way you treated if you do not own the car.

Edit: I see you have contacted BMWNA. Do you own the car?

As for the Insurance issue, you could have shown the Dealership your insurance for the car which should cover their loaner car (providing your insurance does that).

Bottom line. Document everything, including how long it is out of service for lemon law as BMWNA appear to be unhelpful. Of course, the laws of CT or NJ would apply - wherever you actually purchased the car, not NY law.

I'm assuming this is brand new?, surely the dealer would have done some sort of check during preparation prior to handover, however just noticed it's a 335i, maybe they took it for a "road test" and broke it, did you notice any miles on the clock?

Yeah out of state dealers...... Almost went that route but for the $200 savings it was definitely not worth it. My dealer seems to like that he lives a few streets from me, don't know why.

Not the same experience, but a bad DME after about 5K showing a drivetrain malfunction. I have been waiting for the part since mid June, but my dealer has provided a loaner from the beginning.
Your wait should be shorter since it seems that according to my shop, the DME has been retooled and should be available soon.

BMWNA does not require that dealerships even have loaner cars. Its entirely up to the dealership. This insurance issue means they won't give you a loaner for any service either.

Since you never drove it off the lot, I assume you never signed any paperwork, which means you never took possession of the vehicle. Request your deposit back (if any) and walk away. Go to another (reputable) dealership closer to home. You can't be saving that much by going out of state.

Hey guys, hopefully should hear something today. As for the car, I signed all the papers and then walked out to the car that wasn't starting. It had 70 miles on it as it had to be brought in from another location and from what I heard, had no problems during that drive. As to HOW they drove it, IDK....

I'm definitely going to keep all the records and keep the car for now. If it keeps giving me problems down the road, atleast I'll have documentation that the car wasn't right from the beginning. This car has already been out of service for 5 days. NJ lemon law says 20 cumulative days so I'll keep that at the back of my mind too.

BMWNA's stance is that loaners are dependent on the dealership, not them. The loaners insurance policy from what I understand applies to the state the loaner is registered in and the immediate surrounding states.

For now, just gotta wait and see what they say today...

Friday's come and gone....still nothing.....BMWNA seriously dropped the ball here. Absolutely terrible customer service. I've surprisingly had better experiences with Comcast!!!

FYI: if you haven't taken physical delivery of the car ie, driven it off the lot, you aren't an owner. Also, take up to 30 days for the contract to be bought by BMWFS anyway + report of sale to the state for registration purposes (not all states allow dealers to register directly), what you NEED to do is tell the GM you want the deal "Unwound." That basically erases all of your commitment to it and returns any deposit you put down. ALL DEALERS can unwind deals anytime at their discretion but of course they'd rather not so will be hesitant. Be direct and hold your ground. If it comes to it (which it shouldn't) communicate that you're willing to take the matter to court (which you would win).

If the dealers worth a shit, they'll do the right thing then fix the issue and sell it to someone else.

That's very unlike them.

File a BBB claim, and they'll perk up their ears immediately.

I would file a lemon law claim too...how a DME is dead on arrival smells of foul play...did salt get into the wiring when on the boat??

If you need another DME, I have a spare one sitting around, just hit me up (Pre 11/2012 though).

Really sucks.

But I wanted to ask you - noticed you're in NYC - if going out-of-state you considered the fact that NY is a California Emissions warranty state (so are PA, CT, MD and RI) and buying out-of-state means you're not covered by the CA warranty? I know there is something weird about NY's membership/warranty in that compact, however...

That doesn't sound right to me. When I bought my custom ordered 2008 335i it was at a tiny dealer in the middle of nowhere (Louisiana). The car only had 4 miles on the odometer. 70 miles seems pretty extreme for a new, custom ordered car. I am pretty sure they have a truck that delivers their cars to them. You can always check out the other new cars they have on the lot. If their story is true, every single car should have over 70 miles.

The whole thing just doesn't sound right to me. While it would suck to wait, it may be worth it to just cancel the deal and go to another dealer.
