3 inch DP vs. 4 inch DP for 335i?

My right tip turns black every few days. The left one is usually clean. I have the stock exhaust too!

I unplugged the actuator on my left tip so it always gets dark too. I also start my car and let it idle for about 5min every morning before driving so that's why a little exhaust soot gets on my bumper/trunk

Does throw a code or trigger the CEL?

So, mean non-matter DP in 3" or 4", still should come with JB for eliminating the CEL code, rite?

I've got JB4 and the ER DP for 3 weeks and 1 week respectively. Got a CEL on the way into town today in heavy rain.
