It's a bit like getting married in a way. Your deposit is the engagement ring. You can have doubts all the way to the altar, and can call it off before the pronouncement. But don't expect your engagement ring back as a right. If you are lucky, the bride-that-was-to-be might throw it back at you.

Two things: 1) your crazy for not wanting to get EB, I had an EB 335 and went into a black 340 and I wish I got blue all over again. 2) Deposit is just a way for them to know they have a serious buyer, you not obligated to buy the vehicle, I'm sure someone else would jump in a heartbeat to get the Beautiful color anyways.. My brother liked the blue so much he got the Monte Carlo blue and he loves it more than his black 535 my dad is forced to drive lol

That's a possibility, but a very slim one. Chances are his contract says something very different. Typically a deposit is taken so that if the buyer backs out the dealer doesn't end up taking a loss.

You can opt out if you haven't signed anything other than an order sheet. But your deposit is likely going to be gone, especially if it's based on the color.

I agree with the other advice to read your contract. People do back out of their ordered cars, and dealers know this. If it's a special order they know they're going to have a hard time reselling, they'll charge a higher non-refundable deposit.
Some dealers will let you out without a problem, others will keep the deposit. So it always comes back to the contract. I suspect if you order a different color vehicle from that same dealer, they'll be a little more forgiving. As for EBII, I personally love colors that change depending on the lighting. My ocean blue E46 was like that - friends would literally comment, "I thought you had a black car" or "I thought your car was blue", and once "You got a purple car?" EBII is light blue in direct mid-day sun, darker in shade, richer blue in low sun and overcast, a touch sapphire/azure sometimes. My daughter teased when I got it saying, "It's a little young for you" referring to the color, but we all love it in my family. My dark blue E46 would get random women saying they liked my car, the EBII gets random guys saying they like it. For what it's worth. |

I have no regrets going EB, but that's besides the point.
This kind of a deposit usually has to be refunded if the customer has not taken possession. The dealership will have a hard time proving damages. What they can reasonably do is hold your deposit until they have sold the car. Incidentally, when I ordered my EB F30 the deposit wasn't processed until the morning of signing the papers; very unlikely they forgot about your deposit. Of course they prefer to sell you the car you ordered, but it will eventually sell to someone else at which point I doubt they could care less. They might be less willing to deal with you again, but if you really don't want the car you ordered and haven't signed lease/purchase papers for it then all you have to live with is this guilty feeling some in this thread try to force upon you. |

I'm picking up a 2016 Estoril 340 on Thursday. I love the color and the way it changes in different lighting. Color is so personal and you have to be happy with it. But I think you're just having pre-wedding jitters. It's an awesome color.

This isn't a "man up" situation at all. It's a business situation where the poster signed a legal contract. Whether they have or have not charged the card is not relevant.
"I'm not sure I like the color after all" sounds more like someone who just painted their bathroom. So no, not a man-up situation, more of a " how old are you, really?", or " how about you get your head out of your butt and do some growing up?" situation. |

BMW passenger car sales have been lagging in the U.S. In 2016 3 Series sales were -26% but things have picked up for the month of January. Maybe your dealer would be willing to work with you to get a sale if you pick another car. OTOH with sales/revenue possibly down they might want to hang on to your deposit, if they can. As mentioned, your contract is the key.

I have a 2014 335i in Estoril Blue. I love the color more and more with time. It's bright and sunny today and the car has this tremendous depth to it (I did spend several hours detailing recently). It looks even more gorgeous at night.
I do agree that at times it is a bit "brighter" than I care for, but overall, I love EBII. It will be my first choice for any future BMW. To your original question, read over whatever agreement you signed. I'm sure this is not a unique circumstance and I'm sure there is some [BMW] protective verbiage that will probably let you off the hook but at a cost. Good luck man |

I'll be ordering soon, and am also agonizing over color. I kinda want something different than the MG I have now. But most times I look at it, especially towards dusk...it looks freaking awesome. So, can't make up my mind! I see you're also in the Raleigh area. If you're working with Performance BMW, they've been very reasonable with everything I've ever asked for. My suggestion: just tell your CA your concerns and see what they say. They've had some really bizarre and high priced F30's in stock before, so hopefully they'll just say "no problem". |

I had a similar reaction to the color at first. At first glance, I fell in love with the Estoril blue. Then after a few weeks of looking at pictures, I started to question the color and thought that I might grow tired of it after a short time. My wife only made it worse by telling me I would probably grow tired of the color. I went to the dealer a few times to look at it in person before I bought it just to make sure.
I have only owned the car for a few months but I have only come to love the color even more now. I had debated on getting it in black but now am so glad that I didn't get any other color. I think the color is not only striking but it does change a bit depending on the lighting, which makes it very unique in a positive way. If you decide to buy the car you ordered I don't think you will regret it at all. |
