2013 F30 EPA Rating

If anything has been posted about this, I didn't find it. When the F30 was quite new last year, the EPA yanked the 328i's 34MPG highway rating, asserting that their own tests showed it was only 33MPG. BMW complied, even though it meant that the 328i was rated less economical than the F10 4-cylinder counterpart.

I saw a 2013 328i on the dealer's lot yesterday. Its EPA rating is 24/36 city/highway. That seems more like it. If there have been any changes to the car to achieve this, I'm not aware of them.

I've done a few road trips in my 2012 and had 36 mpg on all of them. I was hoping for 40+, but the 2013 sticker seems closer to what I actually get

They haven't posted the 335i w/8 Speed Auto yet.

Also, they have the X1 28i S-Drive rated at a higher MPG than the 328i... Same powertrain. The X1 is heavier, and less aerodynamic. Something smells fishy.

How can the 328i have worse fuel economy than the heavier awd 328xi and even worse economy than the even heavier 528i?
