Edmonton BMW - Not fulfilling the contract
Three weeks ago, I negotiated with a SA at Edmonton BWM for a brand new 328i X drive sport line that they had stock at the time. I was specifically that the car was equipped with 19" rims and summer performance tires. I took possession next day. One day later I discovered that the car had 18" rims and Continental all season tires. I went back and talked to a Sales manager there, who check the car and checked their system and showed me that the car had been ordered with 19"s and performance tires. He told me he was going to talk to BMW Canada and get my wheels. For the next 2 weeks I was told that the wheels were coming. Today I stopped by and they told me that all their 2014 cars had been switched to 18"s and that the VIN shows that the car had been ordered and delivered to them with 18"s. At all my comments they only had to say that they could not do anything to reimburse me and that I should take it up to BMW Canada. Which I did. BMW Canada on the other hand says that they can file the complaint and email back to the dealer but they cannot force them into doing anything.
Please let me know what you guys think, what is to be done if both of the entinties refuse to do anything. |

wait a second. Your deal is done with Edmonton BMW. You paid Edmonton BMW directly, you did not pay BMW Canada. Therefore, Edmonton BMW is the one solely responsible for the contract, BMW Canada can only be advised of what's going on and in case the dealer is playing game, you have at least open the file with BMW Canada to follow up with.
You can also take up the issue with your local gov't agency that monitor & regulate the automotive sales industry. Gather up all documentations and send them to all related parties. In terms of the retail value between 18 vs 19 wheel package, you are probably looking at about $1000. Stay focus and don't let the dealer off the hook. You should also take your case up in the social media such as facebook and twitter and see if the dealer is going to rethink their position from this unwanted publicity. |

...and my car had been set in their system with 19"s. The sales manager and I looked up the car in the computer and it was clearly showing 19". But the VIN shows 18"s. From here on I cannot say what happened and when but the bottom line is that the sales manager told me they cannot do anything to accommodate me and they are not going to credit anything back. Period.
I have just send him an email to let them know that BMW Canada filed the complain and that the responsibility lies on the dealer's shoulder. I am somewhat surprised to discover that a BMW dealer is trying to drop the ball just like that. This is very poor customer service on their end. |

thats complete bait and switch bullshit.
a similar story happened a few years ago when I went to purchase a mustang. I get to the dealership and theres a mustang i want with a price written right on it. We get inside...do a little negotiating....right as im about to shake his hand...he tells me the rims and tires are an extra $3k. i stood up and walked out

Got a reply from the dealer, the same sales manager.
"Hello Ben, I apologize once again but this was not a mistake, as mentioned all of the wheels were switched to a all season tire rather than a performance tire. If this was a mistake from the factory it would have been corrected but it was a decision made at the dealership to equip the vehicle with the most suitable tires for our weather conditions. I assure you this wasn't a mistake and I wish you all the best with your new vehicle endeavours." |

Sorry. Dealer is simply trying to pass the buck here.
... the dealer (if they valued their name & business practice) should step up to the plate and correct their mistakes by honoring the 19" wheels & performance tires. If this is written into the contract, then they need to fulfill their part of the contract. Period. After all, you paid based on 19" wheels & tires spec. , I guess you will have to take it up to the next level, BMW Canada and your local automotive sales governing body/agency. |

To the best of my understanding, its the other way around. BMW started putting 19" rims and high performance summer tires on Sportline models beginning of 2014 calendar year on MY14 328's (at least in Canada). They previously had 18" rims w/all seasons.
I know this because I noticed this change over and specifically enquired when I bought my F30. If the production date on the car is older than Aug 2013, then its possible it was built w/18's….. Quote:

Ordered mine in May and delivered end of July 2014
Like someone mentioned above ALL sport line 328i's made in 2014 come standard with 19 inch rims, not the other way around. Previously it was 18 inch standard with option to upgrade to 19. |

A contract is a contract, if you signed and the sales manager signed its legally binding.
Just the same as if you were to skip a payment you can imagine the consequences. This could also be argued in small claims court which undoubtedly would be in your favor if all the t's were crossed and i's dotted. Also if they aren't willing to upgrade the rims this would allow you to forfeit from your contract with them since they are rescinding on the original terms. Hope this helps you out buddy |

it should cleary state in your contract when you signed for your car. as long as you have documentation stating the 19" rims and upgrade price you should have an easy win to fight this. i got the upgraded wheel performance package and it clearly states on my contract when i signed. take it as far as you need to but you have all the proof showing whant you paid for.. good luck
