Dealership Credit Note

Afternoon all,

After some advise on the following situation.

I had a service plan on a non bmw car a few years ago (2021), car went into a dealership and was quickly evident they had not done much if anything to the car. I chased the dealer to no avail and eventually got their UK customer services involved whom managed to get the dealership to re-service my car but also give me a £350 credit note to use for another service or parts. I basically got a one liner from the service manager stating this - no further terms or anything.

The car in question was written off just prior it needing another service in 2022, another new car (same type, newer model) was purchased in 2023 which now needs it first service. I've been in touch with the chap who sent me the email and he's stated the credit was only for the original car not the new one - nothing like this is mentioned in the email and at the time i was told i could use as i want, against another car of the same brand if we had one. He's said he'll need to seek authorisation for me to use the credit against the new car but its been a week and nothing, chased by phone and told the manager was off and he'll get back to me - but a few days gone by and nothing.

Where do i stand with this? There was zero mention of the credit being for the original car and i'm getting bit peeved with the silence at the moment, thinking to either go back to their UK customer services or copy in one of their senior managers to the email chain.

Is it unreasonable for me to expect the credit available for use against the new car?

If there are no clear, written, conditions (i.e. the credit can only be redeemed in connection with the original car) then it’s simply an ‘open’ credit note. You can redeem it as you see fit.

If it was issued by the dealer, then it should be honoured by the dealer, no matter what car it is.

You wouldn't get a credit note from M&S for some size 12 underwear and have to buy that exact size underwear again, would you? You could buy anything in the store for the value of the credit.

If it were me and they were playing that card, I would book the car in for a service, have it done, then show them the email/ letter or whatever when it came to pay the bill. If they make a fuss then just walk out with your serviced car. They will never chase you for it. Never.

Then write a snotty email to the dealer principle detailing how they are scammers and you may get another service for nothing, too!
