The RB wing passed the current test and was allowed to race without incurring a fine or penalty. Inventing a new test to hinder ANY team mid season is crap. If RB found a loophole or work around good for them. Change the test next year.

If it was a loop hole, there would be a need for a rule change and they'd probably be allowed to run it for this year. (Like DAS last year, all teams were free to develop it but choose not to)
Since it's more of a violation of a current rule, they just needed a way to test wings to ensure compliance. So it's not even bending a rule.
If they were to find a loophole, like Blown Diffusers, DAS, etc. Then sure power to them, but this doesn't look like the case, atleast in FIA eyes.
