Wouldn't be surprised if that was the case, when I first got my 340i with MPPSK installed I thought it was ridiculously loud and wondered how they ever got compliance for the noise levels.
The MPPSK exhaust is effectively a straight-pipe with no resonators when valve flaps are in the open position
