It could be but we need a lot more details. How did he get caught? What parameters did they check? did he leave any physical evidence from the install of the tuner? Was the car ever reported to have been tuned prior to his last visit?
car was stock. it broke the charge pipe, he pulled the jb unit. i dont onow what parameters it was exactly. something about load etc.

Wouldnt that be considered bad on his part anyway? Hes running JB4 with stock everything, adding pressure in the CP would easily make the plastic stock part break.

Not really, I've been running a Dinantronics piggyback, going into 4 years and 33,434 miles and I've not had issue with the charge pipe.

I was actually trying to get mines to break before my factory warranty expires, by dogging the shit out of my car but all that happened is I ran out of gas :

I'll tell you what happen there, without even using my crystal ball; his charge pipe broke, he took it into the dealer, with the JB piggyback still attached because maybe he's just a run-of-the-mill idiot or felt entitled, the service manager saw the JB, on tow and told him to go kick rocks.

Now because of his shortsightedness, he has a misguided notion of a piggyback's modus operandi..
Just like the folks out there that in their heart of hearts believe that Corona beer causes Covid-19 or taking cleaning detergent internally, would clear out the virus. There is no shortage misinformation out there, same as here..

BMW factually doesn't run logs for something as minor as a broken charge pipe but if you leave something obvious for them to notice, they'll tell you to scram, on sheer principle.
