328d Vacuum Modulator replacement/exhaust smell
Has anyone had an exhaust leak from the EGR vacuum modulator on a 328d? Getting an exhaust smell through the vents at idle/stop lights, warming up etc., and upon visual inspection it looks like the source is the vacuum modulator. I was unable to find any threads on this or other sites, no available YouTube videos, and it’s past the time shops are open at the moment. I hope the photos uploaded properly. Thank you!

Looks like there are soot deposits in that area (I don't know whether that's normal) but the most common source of exhaust fumes in the engine bay and through there cabin vents is a cracked EGR pipe. The concertina pipe in your photo should be checked - they commonly fail due to hairline cracks in the folds of that semi-flexible pipe.

AFAIK the EGR cooler and the corrugated pipe are supplied as a single component. Have a look on realoem.com. The EGR cooler and corrugated pipe for my car are listed as a single part number.
If the pipe has split then it may well be covered under the BMW global recall relating to the EGR coolers. Replacement of these parts by BMW are not limited to the term of the original vehicle warranty.
