Update on my long saga...
Just got off the phone with BMWNA and the guy was super helpful (shoutout to Myron!). I told him how the dealership was wrong, BMWNA sent me to Rust, Rust sent me back to BMWNA. He got the whole picture and timeline of the back and forth and is escalating it to a case manager who will contact me in 1-2 days. I'll keep you all posted. Thanks to everyone here for all the help and advice so far. |

The saga continues...
BMW NA is telling me I need to talk to the service manager at the dealership because reimbursement "typically would not come from [BMWNA]." Honestly I was already thinking of trying this route. But, before I do, I was hoping someone could help me with some info/ammo. As a reminder, when the dealership first diagnosed/repaired this, they said it was not covered because on my car, the guides were broken, and the settlement only covers the chain stretching. I, of course, now know that is false because that's how the guides get broken, i.e., the chain stretches and slaps the hell out of the guides until they break. So can anyone point me to the language or section of the settlement that states this so I can adequately present my case to the service manager? I fully understand this probably won't resolve it and I'll be calling BMWNA back. But I'll jump through their hoops, for now at least... |

Hi all,
I am new here and this post was referenced by the e84.xbimmer community. Hoping to find some helpful answers about this timing chain issue. Are there common symptoms that everyone gets with this one? I'm at 155K kms / 96K miles on the odometer. I started getting a whining noise a 2 years ago when I hit about 130K kms / 81K miles that sounds like a bad alternator. I don't really hear any clanging or scratching noises. I opened the oil caps and tried to pull on the chain and it's on very tight. Does not move up/down or left/right. Is the whining sound the timing chain and how much longer do I have? 2012 BMW X1 28i n20 here Thanks in advance |

It is hard to self diagnose just by opening the oil cap. Check youtube where some people have posted the typical tell-tale whine. The definite diagnosis must be done by a BMW dealer or a good BMW mechanic, there is a specific diagnosis they do, which gets data on chain timing and other stuff to determine if it is faulty. Despite all this, and for peace of mind, at your current mileage, I think doing a preventative replacement miles is the best course of action if you plan to have the car for another 100k miles or so.

I have a 2015 320i (7 years old) with 58,xxx on it right now. Are my timing chain and related components covered under this extended warranty? I have had this car less than one month. I love it VERY much. If I could get this done before the engine failed, I would be so grateful. Thank you in advance to anyone who can answer!!!

Honestly, your car will be probably trouble free up to 120k mi, provided you deactivate the Auto-Stop/Start and change the oil every 5k mi. But if I were you I would sell the car at 100k mi.

He may be referring to the time chain guide breaking.
It used to be on the sticker in the driver's door jam.

update on my claim status...
Quote:
In November I received a letter requesting more documentation, which I promptly provided. (looking for a "crickets" smiley to insert here but don't see one) I emailed Gelis in February 2022 asking for a status update; they replied TWO MONTHS LATER stating the claim had gone to BMW for "Final Validation", which would take a minimum of 45-60 days, and that "we appreciate your patience". That was 4 months ago, so I emailed Gelis again asking for an update or contact info for a department at BMW that can provide one and a reason for the delay. I'm living the DMV scene from Zootopia... |

I did hear back last week from Gelis, saying that my claim was preliminarily approved for reimbursement and they expect to finalize the reimbursement amounts in the next 45 days, but no promise as to when reimbursement will actually take place. So don't give up hope...

Hi, I need your help!! I purchased a 2013 BMW 328I xDrive vehicle in 2020, it just broke on 6th August, 2022. We have it towed to the local BMW store, the technician said it is a timing chain and oil pump issue, which resulted in engine failure.
I saw the Gelis case and called BMWNA, and they said because of my car was 9 years old and has a mileage of 96,000, so I am not qualified for the warranty. I argued that as the file stated, even though my car is out of warranty, based on the mileage, BMW still have to cover 55% of the total repair cost. But they said that to be qualified for this reimbursement, I have to file a claim before the deadline in 2021. I did not know there was such issue, as I am not the first owner, I did not receive any notice. The BMW store said the total cost would be probably over $10,000, which I could not afford. Is there anything I can do at all? |

2012 N20
I purchased a used F30 with the N20 motor. Seller stated it needed a starter. Did that, new battery too. Crank would not turn with manual effort. Neutral switched on side of tranny, still no turn. Open valve cover inspect cams- Good. Shine flash light into timing chain guides, a piece is broken and wedged in between timing cover and block. Also can see the oil chain sprocket with no visible chain on it. Appears to have thrown time. My question is can the engine be recovered with new sprockets and chains provided no valve train damage or piston damage has occurred? And what are the chances the oil pump rods and spider gears have been damaged? Where can i get parts? Is this a DIY? Does the motor require programming after the rebuild?

You might be lucky that nothing was damaged but if the pistons were run against the valves then you clearly have some tasks in fromt of you. Since the you can't turn the crank manually it might be that some piston is already touching valves. Have you tried to turn that crank slightly backwards? I guess it would be usefull to get an endoscope camera.

Also, here's how quickly the guide's white plastic turns color. Had the timing chain job done 19 months ago and ~15k miles ago. 5k mi OCI, and it has yet to consume any measurable amount of oil in between changes in the 5 years I've owned it.

You could send a letter to the court asking for clarification. Would only cost you the price of a stamp and may help others with a similar situation. Perhaps you paid taxes? I would assume that they would not cover the cost of taxes however I do not know this as fact.

ORDER Implementing Mandate on Remand. The judgment of this Court entered on May 7, 2021 order is hereby vacated and the Court will proceed with the current action in a manner consistent with the United States Courts of Appeal for the Third Circuit order and opinion issued on September 9, 2022. Signed by Magistrate Judge Cathy L. Waldor on 10/6/2022. (qa, ) This appears to be over an argument on how much the lawyers should be paid and not in regards to the consumer settlement. |

Old but interesting, the last letter in regards to the case shows some values of the case...
What should be taken into consideration as one factor under Gunter is the monetary value of the results achieved by class counsel. We now possess additional information to conduct a common fund cross-check of the lodestar. Based upon information provided by Mr. Dalton at the recent fee hearing, we learned that in addition to the $3.5 million in reimbursement payments, (which may not include the recent successful appeals for which checks have not yet been cut) there was approximately $13 to $16 million in covered prospective warranty work performed to class vehicles by BMW NA authorized dealers. In addition, because BMW NA is paying the legal fee separate from the claim fund, it should be added to the settlement value, not deducted, in performing a cross-check. In other words, one should first add $3.5 million plus $16 million plus $3.7 million equaling $23.2 million and then determine what percent that $3.7 million is of the $23.2 million, which is approximately 16% in terms of a cross-check. Using the $13 million number instead of $16 million, the percentage is 18%. |
