I am the second owner and I bought the car as CPO Elite with just under 10,000 miles at BMW of Dallas. I've taken very good care of her, garage kept, all services performed at BMW of San Antonio (outside of the last oil change). Clean title in hand.

~60,000 miles on the odometer, mostly highway miles from commuting to and from work. As is the case with many daily driven cars, there are some rock chips here and there in the paint, but overall in very good condition inside and out.

No, the car does not have, and has never had, a tune. A tune (bootmod3, JB4, etc) would fix the CEL for the downpipe though.
