This is a serious safety issue indeed, that must be brought to NHTSA and DOT.

Imagine that BMW would replace the brakes with the M Calipers if this was the case wish they would!

It didn't happen to me yet, but I'm wondering if I take the car in to the dealership and told them about this they will look into it? btw I got my car on 8/12 so it should be a 7/12 build.

I was giving BMWNA time to work it out, but I've lost patience with broken promises to call me back.

As of now, the car has been in the shop for 27 days. In 3 days it officially qualifies for Lemon Law in California. What's disappointing is that BMW, locally and nationally, knew full well over 3 weeks ago that they wouldn't be able to repair it before 30 days lapsed. I requested and started buyback proceedings, and they've drug their feet the whole while.

The sad result is that after 4 BMWs in the last 10 years, 3 of them M3s (the 328 was the first non-M) they've lost me as a customer. I'd originally planned to take the buyback and buy a 2014 335, instead I'll be going elsewhere.

i think it happened to me this morning. was crawling along at 2mph to pull into parking lot. All of a sudden, brake pedal is rock hard. I had to throw it in park to avoid hitting the car ahead of me. Restarted the car, brakes felt normal. A bit worried about driving home tonight. Will definately bring it in for service. Mine is July 2012 built

This has happened to me twice, once in February and again today. While rolling to a stop the brake pedal becomes hard and will not depress any further, yet the car is still moving. I call it more like a glide feeling. In my instance when the car finally stopped the engine would rev to 3000 to 6000 rpms but not lurch forward. My only recourse was to shut the car off and restart. They are going to replace the vacuum pump, so I will have to see if this fixes the problem. I have read some posts about BMW buying back the car and this may be something I will have to pursue if it does not get fixed. This is my fourth BMW, all with no troubles until the 2013. Not a very good feeling.

Had the vacuum pump replaced yesterday and unfortunately that did not fix the problem. Today while rolling to a stop the brake pedal become hard, and the car went half way through an intersection. Luckily no one was in front of me or in the intersection. Back to the dealer in the morning. I was advised by BMW to take the car back to the dealer and request a BMW engineer to come and look at the car.

Just a quick update, the car is in the shop waiting for an engineer from BMW to come later in the week to try and figure out what the issue is with the braking system. The NHTSA did contact me after I posted a problem on their website and are interested in hearing BMW's response. I was told that their is a service bulletin, on the 2013 3 series with Active Hybrid for brake issues, but would not give me any more info. The engineer is suppose to be at the dealership on thursday, so it's just wait and see.

1) If the AH3 is the same issue, wouldn't this indicate that the problem is not limited to the 328s which have been noted in this thread?

2) What did you find out after the engineer showed up?

So the latest is that they decided to replace the Vacuum Pump, Check valve and Camshaft in my vehicle. The car was in the shop for 27 days and got it back about three weeks ago and wouldn't you know it but last week I was getting a weird feeling in the brake pedal, but the car would come to a stop as usual,so I figured maybe they fixed it. Well last friday,while out of town, I applied the brakes heading into a traffic circle at a slow speed and the pedal once again got hard and the car continued forward. Also, the engine once again revved to about 3500rpm as if in neutral, and not pulling forward. A quick pump of the brakes and regular breaking returned until the very next day, same issue.

As usual BMWNA customer service was notified and I told them that the car is unsafe to drive and I would have it towed the 135 miles back to the dealer at which point they informed me that I would have to pay for the part of the tow over 50 miles. Are you kidding me. You put out a defective vehicle, with braking issues and want the owner to pick up the tab. Finally the dealer stepped in and said they would pay the tow and try to get reimbursed from BMW.

The car once again is at the dealership, 4th time for the same issue and BMW customer service is non existent. The executive customer care gentleman that I have been dealing with, has not returned numerous phone calls or emails, even after I was told he would call me back when he got out of a meeting.

The dealer tried contacting him yesterday and so far no response even back to them.
I fully understand if the Service rep was on vacation, but still three weeks with no communication.

Needles to say, BMW is not the BMW of years ago where they took care of their customers.

While searching the NHTSA complaint files there are 6-9 complaints with the same issue I have described and all early builds of the 3 series including and x3.

So once again I am driving a loaner as my car sits at the dealership waiting for some type of guidance from BMW.

I too am having the same issue. BMW advised me that they will be changing the vacuum hose but after reading the posts above it seems that this is not a permanent fix. They said that I will get my car back in a few days but I don't feel safe driving it anymore. I'll be contacting a rep in the lemon law dept and will also check to see if they will offer a buy back.

Good luck with their customer service. My car has been back at the dealer for a week, and the customer service specialist handling my case has not responded to numerous phone calls and emails for the past four weeks. I just want the car back at this point to either do a Lemon law case or dump it all together for another brand. This has to be the worst customer service I have ever had from any company. The dealer is involved but is also getting the run around from customer service. There is a regional office in a suburb close to where I live and I am going to stop in there to see if I can get some help.
