GDPR issue with O2

To cut a long story short I had a quite heated discussion with one of their operators over an ongoing issue.

I ended up putting the phone down on him as he was being particularly obstructive.

He had a very distinct voice, anyway literally 2 minutes later in get a call from a withheld number, I answered it and it’s the same bloke who says “you fucking prick!” And hangs up.

I called O2’s customer service and they put me through to some investigation team who traced it back and listened to the recording.

Now I assumed he’d called from his personal mobile but they said that the operator had fallen short of their expectations and that he would be relieved of his duties, how would they know if it was his own phone?

My concern now is that this is a potential GDPR breach and I’m not happy as he has my phone number and no doubt potentially personal details and he’s just been sacked.

I’ll be honest I don’t know which way to turn from here?

Any ideas?

Ignore and move on. Life is too short to worry about things like this.

Guy lost his job because he was a twat , nothing to do with you and totally self-inflicted damage on his part.

He / they have your details (they had them anyway) so what's the worst that can happen - you block any strange numbers ?

You have his personal mobile number now and he knows it so any unsolicited and unwanted correspondence would be traceable.

As said , nothing to worry about.

It is indeed a breach of data privacy, we had a couple of cases of staff in hotels taking a shine to guests and messaging them having got their details from the system. Not sure its something that the ICO would be interested in - he has to have access to your details to do his job, they have taken action, it only affected one person... But best to log it with O2 as a breach and see what they say...

And if he calls again log it with them again and then log it with the police. If he doesnt work for them anymore it stops being a data breach and becomes harassment...

I believe GDPR law is organisational not individual. If you think there is personal data breach you can contact the organisation but I don't believe there is any legal remit on individual employees aside from displenary action. If you really wanted to you can go down the civil court route but you need to know who you are taking to court and demonstrate something to claim.

Once a criminal offence has occurred than the police will get involved.

TBF we only have one side of the story and as we know there are always 3 sides in these situations.

I remember having a stand up row on my driveway with an auto glass fitter that had come to replace my windscreen, sometimes two people just instantly take against each other and that was one of those occasions.

Looking back I was also a bit of tit and played my part, he not only had my mobile but knew where I lived, but I never gave it a seconds thought.

Just move on.

Sorry but I found that quite amusing

Let it go. Shit happens. My debit card got hacked last weekend and 200 quid was removed from my account, but I'm not crying about it. Got it dealt with. Move on and focus on more enjoyable aspects of life.
