Far too many issues to consider keeping the car in my opinion. Yes it's a beautiful looking car but if I were you I'd return it to save yourself what is likely to be some hefty bills in the future. You have every right to do this with the issues you have described.

Mileage is nearly 32,000 if that helps.
So with that amount of modifications it’s very possible the internals of the DPF have been removed.

Also it looks like it has illegal tints on the front side windows?
Those front windows certainly look sus to me!

I have already mentioned they're not quite as dark as the rear but have at some point been tinted.

If you can reject the car I would do this. There are too many issues to sort out and you would be better off starting again with a bog standard car and modifying it yourself if desired. There are loads of cars on the ‘net and you will know what not to buy next time.

See what the dealer says, he might just say yes and make it an easy move.

Used car salesmen will say anything to get them through the next half hour, so I would assume that they are not telling the truth about the previous owner.

Yeah I agree .. would need to look at more photos of the car.

front side windows can be 5% more tinted than the front windscreen, so that could be the case there, I can't really tell for sure from the photos.

I don't believe there is a warranty with the car. One wasn't mentioned. It was purchased on finance through them.

I picked it up 9 days ago. I'm not sure it works like that considering it was purchased on finance?
You legally have 6 months warranty and a 30 day rejection period for major faults

I would seriously consider rejecting it's only going to get worse, although may not be easy, if you do make sure you also let the finance company know

Take it to a Bmw main dealer and pay them to check the car over. From what your saying they will be able to identify the issues. You then have your evidence when going back to the garage you brought it from.

Unfortunately the 14 days are up with the finance company in which I have the right to withdraw. This is the 14th day so it wouldn't be beneficial for me to do these checks since I don't have that right after today.

Spoke to the dealer and apparently bmw springs have no markings on them where as I thought they had a white tag.

And an mot was done by an independent garage with a print out of the emissions which have passed.

And its normal for a car with a dpf to smoke and smell. So the car won't be getting returned on those terms.

Not sure who told you that but I have had diesels for 8 years and they don't smoke or smell unless they are not right or about 20 years old

The DPF is there to stop the smoke

These are the dealers words. He won't accept a return because he says there is nothing wrong with the emissions. Due to the low levels when tested by the mot.
Yet I can smell fumes and see black smoke under load and when revved.

Simply its not right. Is the selling dealer an Independent or a main BMW dealer. I am guessing an Independent

You should never see black smoke unless something is broken.

Even my 530D with a remap to 340bhp did not produce any smoke, the inside of the exhaust was spotless

I bet the inside of yours is covered in soot, which is a sign that smoke is getting past the DPF etc

Take it somewhere with the emissions test equipment and tell them your concerns and ask them to kindly test it for you, if it fails get a printout of the results and return the car.

Thanks all, yes the tailpipes are covered in soot after a short journey. And the seller is an independent dealership. They have many high end cars.

That will be my next step to take it to an mot testing station and get them to perform an emissions test.

If it does pass then I'll be very surprised!

The dealer is sending me documentation and proof of the emissions as well so it will be good to compare the results.
