My 335's ruined! Accident pictures

So I was on my couch eating a bowl of cereal when a neighbor called me and told me someone hit my car in the back of my building. By the time I got out the door and to the scene of the accident, the police were already finishing up the report. I got a look and it was so surreal to see my car damaged like that. turns out an older man swerved out the way of a car exiting a side street and ran head on into my parked F30. (which was parked in a single parking spot...the irony)

Dude was driving a rental from enterprise so the claims process is taking forever. I'm going completely through his insurance so I don't have to pay a $500 deductible so I'm still waiting to get approval to take it to BMW. The damage was appraised yesterday so I should be getting things taken care of in the next few days. From the looks of things, front bumper, driver side fender, crash bar, parking assistance, and maybe driver side headlight are gonna need to be replaced. I'll keep you guys posted on the damage estimate when i get the statement. Take a guess in the meantime..

OMG this sucks, at least there wasn't any body injuries.

Is it the angle or the front driver side wheel is toed in? With the hood, fender, bumper, fog light, possible suspension parts, and maybe drivetrain given its an awd, I am guessing about $8K with oem parts...

if anything with the wheel is involved, it'll probably be north of 10k. And it definitely will if you're going through a BMW dealership for the repairs (which I would since they are paying)

Headlight, Bumper, Hood, Electronics for PDC, 1 grille, possibly 1 foglight, looks like side skirt from the angle in the picture?

I'd definitely just pay my deductible if 500 is no biggie to you so you can get the process started and get back into your car sooner.

Best of luck with the process though, thankfully you weren't in it and it could have been worse.

To be honest I never really noticed my wheel toed in like it shows in the pic. I think that was just the angle the steering wheel was left at. Gonna check it out a little more in depth when I get home but Im almost certain its just the wheel turnt slightly.

I figured since I wasn't paying for it, it made most sense to let BMW take care of the damages, especially for paint matching purposes. And like you mentioned with their stealership prices, I'm guessing over 10k for sure.

and i'm opting out to pay my deductible because i've been driving around my e90 328 for the time being. It's slow and automatic but it's gets the job done in the meantime.

If another party is at fault, I just bring it to BMW collision center and let them talk to the other party insurance. Why wait for approval from the other party insurance. BTW, you need a car to drive so shop will provide you with that and they bill other party insurance.

You are 100% not at fault if you were legally parked, and you are 0%in contract with the rental car insurance or dudes insurance. You can have it fixed wherever you want, with rental car, plus diminished value. Your insurance company should recover your deductible. Insurance is regulated by state, so experiences spoken about here may not apply 100%.

That's 10k with new OE parts and no steering/suspension work.

Dude, just use your insurance. You'll pay the $500 then get it back through a process called subrogation. Your insurance company will handle dealing with Enterprise so you don't have to deal with them trying to use substandard parts, etc.

When it's not your fault, USE YOUR INSURANCE. You pay them a lot of money every year. As long as they get paid back (which they definitely will), your rates will never go up. You'll never have to argue over anything or worry about calling them or them calling you. You just get an estimate, pay the $500, they pay for the repairs, then you wait a few weeks and get the $500 back from your insurance company after they get paid by Enterprise.

If his insurance fixes the car, he will be tied to whatever his contract is... so, if he does not have an oe parts rider on his policy, the other insurance potentially makes the better repair. He just has to manage it and fight for what's right. Also your Insurance company will not cover your diminished value, only the other parties insurance will cover the diminished value. You can make multiple claims though, if your provider fixes the car, you can still go after the other party for diminished value.

I agree with this from past experiences and I've been hit a lot . No insurance company is great, what a crap industry . At the same time, your insurance is the only one on your side in a situation like this. Let them fight with the other side and look out for your interests. They are better positioned and resourced to do so. If you prefer not to shell out the $500 before repayment, you can always work with your agency and the body shop to have it paid direct by the other side. Last time I was hit, they had the other side send the deductible straight to the shop so I did not have to, even though the $500 was not an issue. I did not even ask for it, they just demanded it.

You know that if you run it through your insurance, you will get your deductible reimbursed (or waived if you haven't paid it yet) once the other insurance company accepts fault? Might be better than being without a car.

Because it gets reimbursed back in full, and OP isn't really "paying" anything. And if the other party admits fault before the repairs are done, then OP literally "pays" nothing; the body shop only collects your deductible at the end of the job when they get paid.

Look--if OP wants his damaged car to sit around while he waits. I just hope for his sake it's in the fenced and barbed wired body shop lot, and not sitting damaged on the NYC street. Invites people to just start pulling parts off of it.
