Nothing in the PACER system yet, I check every hour. If I see anything Ill share it here. If it's not posted by 5p EST, then it won't likely be up till next week. Fingers crossed.

Sorry if it has already been posted here but where is this taking place? Maybe one of us should have been waiting around the courthouse or whatnot lurking around haha.

Someone call her!

Cathy L. Waldor

United States Magistrate Judge for the District of New Jersey

Staff Information

Judicial Assistant, N/A

Chambers - 973-776-7862 FAX 973-776-7865

Though she’s probably getting all dollied up for tonight right about now. Might make her angry calling now asking about the results and she may reverse them if they were in our favor

Yeah I don’t see anything being resolved until after we pay our taxes.

How much we pay in taxes for this judicial system, that is unable to take any conclusion and keeps dragging and dragging this forever?
I wonder... Is this problem only in USA vehicles?

This is our judicial system which highly favors the party with the deepest pockets. The BMW Corp lawyers will request more discovery until the plaintiff lawyers see that any settlement will likely not cover their costs plus the profit margin imposed by the firms managing partners. This happens all of the time. If the number of vehicles impacted were greater, you would see the NTSB lawyers involved to assure the safety aspect was addressed for a substantial consumer pool....don't see it happening here. At best, I suspect, there will be a limited settlement with the named parties and not the entire class. I hope I am wrong....we'll see

If/when there’s someone dead because their BMW stoped in the middle of the freeway and then got hit by a 16 wheeler truck, then it’ll be too late for BMW.

Time to ramp this thing up

This has been going on for too long. It has been forgotten by the media. We need to unite! I challenge everyone to post this to every social network, every car blog, everywhere over and over. I would even like to organize a national protest day where we can picket the dealerships. We need to hit BMW in the pocketbook or they will never act. We need to shame them into settling. We the consumer need to show BMW that we have power! Notify your TV stations to do a segment on this. Let's all write a letter to the judge. Let's ramp this thing up!

I have already started a letter to the judge explaining what happened to me and how it could have cost me my life if I wasn't an experienced driver. (Drive for a fire department) I haven't sent it yet but will this week encouraging her to not forget about the 1000's of us, whom most are likely still paying for a car that is unusable, etc. She did fast track it, so that is a good sign to me. I am not a legal person by any means but I'm usually pretty good at reading between the lines. I have a feeling BMW came in 'unprepared' and the judge had enough of the stalling. She is new to the case, this is the third judge over the past, nearly three years. Oh, I am an optimist too so there is that, lol.

There is absolutely nothing in the text to support your “feelings”.
Parties failed to reach a settlement and now the legal discovery process resumes
I doubt that sending a letter to a judge creates an admissible piece of evidence. It will most likely end up in a garbage bin.

You know the judge will not pay attention to such letter, as it came outside the trial, and she has to be impartial.

Furthermore, and your letter might do more harm than good to the class action suit. Assuming you want BMW to be forced to recognize their error and make good of this wrong.

It’d be good, though, to send the letter to the class action suit lawyer team, or as an Amicus Brief (spelling?) as an expert opinion.

I think your reply was addressed to someone else, but regardless unless your N20 actually gave up, you would be filing a fraudulent claim and committing libel. You need to at least suffer damages first
