I think having the HVAC system completely off is considered a safety hazard for a number of reasons. Carbon monoxide can enter the car, windows can fog, etc etc etc. That's why it will always be on in some form when you start he car. Blame the lawyers.

Is this the case in previous e90 series? I don't recall ever having my HVAC turning itself back on the next time I started the car. I was told by the PDI techs to have the computer reprogrammed when I come in for the first service to remedy this when I told them about the issue. I will try it in my other BMWs.

My 2006 E60 530i did this as well. My dealer wait this wat to prevent window fogging after start. It never really bothered me because the temp setting was always how I left it last.
