The BMW chcecklist for CPO says nothing about accidents. (attached)
It does require that body panels, etc. be up to "BMW standard." If the fit and finish are far off, there is a legitimate gripe with the dealer.

My wife's brother bought an 2014 Infinti Q50 in 2016 with 2k miles on it. Car turned out to be a bust and it was a CPO car so he thought nothing of it. Found out 3 months later that the car was in a MAJOR accident! What caused him to find out is the fact that he started to have random airbag lights, the headlights wouldn't auto-level, water was leaking into the headlights, fog lights would come on and go off as they pleased, his front and rear parking sensors wouldn't work, had issues with the traffic aware cruise to the point where when it was supposed to slow down it would speed up. Which leads up to how he really found out! He hit a deer and took the car to a body shop. And they told him that his car was in the exact body shop for a 15k repair estimate. And they said the car was supposed to come back for repairs but never returned they took it away on a flatbed and that was the last time they actually saw the car! Well he didn't take that well and angrily went back to the dealership and asked for a refund. Took 2 months but they took the car back and he got his entire refund back! And the car has been parked at the back of their dealership ever since I still have no Idea on why they still have the car.....When its no good.
