My timing chain broke in Sept 2018, causing a full engine replacement. I did not file a lawsuit because somebody at BMW told me to file a formal compliant with them. I called BMW back today to check in and the guy had no idea what i was talking about. Am i SOL at this point?

I had almost traded the car in before my chain went. I had gone to a Subaru dealer and had the car appraised for trade in. Your case is really unfortunate, however inaction on your part does not seem reasonable. Why not spend 5k or so putting in a "new" engine and continue using the car. Look at it this way, for 5k you can have a pretty decent daily 5er.
Keep all records, use reputable shop. If anything comes out from the lawsuit good for you, but keeping the car bricked does not do any good to anyone.

Yes, OEM mufflers are scraps, they told me .01 per pound , 25 lbs ? must exceed $1 before they pay out .

I am fortunate enough to have two other cars to use while this car sits. I am not going to dump more money into the 528 until I see the settlement of the class action suit. Other than still making monthly payments, the car is costing me nothing to sit... If the suit fails and it's not covered than I will go to an indy shop and have a new engine put in if I can find a decent price. The dealers wants $18,000 for a new engine.

I don't think it will significantly affect the used car price. Most of the peoples buying cars without doing any serious research.

Dear Judge Waldor:

We represent Defendant BMW of North America, LLC (BMW NA) in this matter.
Pursuant to the Court’s February 14, 2020 Order, we submit this letter to identify BMW NA’s
view of outstanding discovery that remains to be completed.
The parties had exchanged written discovery before going to mediation. Plaintiffs’
responses are deficient, both in the content of Plaintiffs’ interrogatory answers and the dearth of
documents produced. We will meet and confer with Plaintiffs’ counsel regarding these
deficiencies.

Additionally, we will have to conduct Plaintiffs’ depositions and arrange for inspections
of their vehicles. Because there are twenty Plaintiffs in this case, from fourteen different states,
the time to complete such depositions and inspections will take significantly longer than the
thirty days the Court proposed.

Finally, since this is a product-defect class action, the parties will necessarily be
conducting expert discovery once fact discovery is concluded.

I'm no lawyer but as a layman it reads to me...

BMW - Judge, they don't know what they are doing. We didnt get the information we asked for and when we do we want to talk to each person and look at their cars too.

Uuummmmm... The cars were likely fixed many years ago, nothing to see. I hope the judge says no, you have 30 days! Get it done.

They are going to depose all 20 plaintiffs and arrange for inspections of each of their vehicles...

And this is only the Fact Discovery phase... once complete they will move on to Expert Discovery phase...

The MINI case was filed on 3/12/2013 and settled on 7/26/2016.

The N20 case was filed on 9/22/2017.

MINI case took 3 years, 4 months and 25 days to settle.

As of 2/25/2020 the N20 case has lasted 2 years, 5 months, 24 days.

There would still be 11 months and 11 days left if the case lasted the same duration.
