Warranty Issue

A few days ago, I was greeted with a check engine light upon starting my '13 ActiveHybrid 3. Got the code read and sure enough it was a sensor inside the fuel pump going bad. I asked my dealer if this would be a repair covered under the California Emissions Control System Limited Warranty, which lists the HPFP as a covered component (I'm outside of the 4 yr/50 warranty, but still covered under emissions). They did a fair bit of research, and apparently the failing sensor is part of the high pressure fuel pump, and not sold separately on the ActiveHybrid 3, thus requiring a replacement of the whole HPFP assembly. I'm being told this is not covered because it's not the pump failing, but the sensor.

I don't understand how this is not covered. If the HPFP is a single unit, sensors and all, with no parts available to replace separately, and a part of that unit is failing, how is that not covered?

I get that in a sense you can say "oh, it's a sensor failing, not the pump", but if that sensor is integrated right into the pump and there's no way to replace it on it's own, then is that not a failure of a component of the pump?

Would appreciate opinions on this. I never want to be that ass that is a complete pain, but I really am having a hard time understanding the logic behind what the dealer is telling me here.

Contact BMW NA and complain - they may be able to get a "goodwill" repair or some financial assistance for you. They should replace the entire pump unit at either no or minimal cost to you. Not sure about the N55 engine, but on the N54, there was an additional 10-year/100K-mile warranty just for the HPFP after the numerous failures became a national news item.
