I’ve had Allstate try to pull that on me! It got ugly...

Glad you are OK.
It's the insurance carrier that makes the final determination. Please update us when the decision is 'totaled' or 'will be repaired'. |

That sucks, but glad you're okay which is way more important than a damaged car.
As to your question on it being totaled, that is a tough call...with the age (going on 6 years old) and airbags deployed I have to think it will be. That being said, I have a 2015 335xi and I was hit a few months after purchasing as a CPO 2 years ago with ~30k miles. They did not total mine, but my car was younger and the airbags did not deploy...however it took 3 months to repair and the repair charges landed around ~$16-$17k. In my case since they did not total it, I worked with State Farm on a diminished value claim. Good luck with how it plays out, these situations are never fun. |

Thanks for the concerns. I am a trial lawyer with Cayenne to drive and the resources for a long fight if necessary. I have Westfield insurance which is a better company?
I was not cited other driver was. I may get a 640 Grand Coupe or a newer Cayenne and... I LOVE this 435i and especially the colors. It came with the tint. |

Could the insurance carrier claim this when we use tint following state regulations?

I guess if it’s illegal, the insurance co has the right. It looks like the other driver hit you.

The car is definitely totaled and given the fact the other driver was cited the insurance company would be nuts to give you a hard time about tint. Insurance companies are sued all the time for bad faith and juries tend to side with the plaintiff. Not saying that will happen here, but it is a data point insurers have when they weigh their next steps on these things that favors the op.
Glad you are okay, have fun shopping! |

If you're within state regs you're fine. But keep in mind that the windows are at 70% from the factory. That means if you're limited to 35% you can only use 50% to arrive at that. If you use 35% tint with the 70% factory glass you end up at 25%.

It's always interesting to see, what's being considered as totaled in the States. In Europe, this would be most likely an easy fix worth doing it. At least expecting the airbags did deploy accordingly. I've seen few Audi A4/A5's that deployed all bags in smaller accident than this.
Glad you're good! |

Since the other driver was cited and not you, the insurance company to worry about is the other driver's. Just make sure that they fix the car if they determine it is not totaled, do not accept a check which will turn out to not actually cover the full cost of repairs.
Most importantly glad you are OK. Stay safe out there everyone. |

Did you have a passenger? I thought the bags weren’t supposed to deploy if the sensor doesn’t detect an occupant in that seat.

Please don’t let them undercut your estimate. Properly written that’s at least $25k, and if that car is not properly repaired it will never be safe again if it’s in another accident.

Ultimately, it can go either way you want. If you want it totaled, a diligent shop can write the estimate per OEM repair procedures and it will come over the value of the vehicle.
If you want it repaired, there are shops that will write the estimate without actually knowing the proper OEM procedures and their true business costs and repair it. You'll probably be OK but possibly have some issues down the road. Side note-airbags are expensive in a relative sense but its the items that go along with the airbag replacement that get costly. In your case, door trim panel, headliner, all the conjunctive labor to change out the headliner, the SRS control unit etc etc etc. Glad you're OK, the car did exactly what it was supposed to in this case. Fold up and keep you safe. My best advice to you, find a shop you entrust and let them handle it with your insurance. DO NOT allow the insurance to send you a link to photo estimating app or them to see the vehicle at your home or a tow yard without a shop representing you. |
