We managed to track down the customer service agent involved and asked him to expand on his answer (he asked not to be identified):

It's a known fault. There is a TSB which fixes it. Don't ask them, instruct them and give them the tsb number. I'll dig it out when I have my Mac in front of me.

Tell them and this includes BMW CS that their response is inadequate and you will involve trading standards if they don't take a more proactive response

Please do post the TSB as I have the same problem & can get it sorted before my warranty expires.

Yes please do, my climate control is also possessed. Im about to duct tape the footwell vents as i get sub zero air blasting down there regardless of which air vent i select.
