I would still first contact BMW USA as has been suggested. With a clearly outlined document of timeline events, communications, including the offer of $5000 that was withdrawn, and the pictures, you can fax, email and/or send that to BMW USA for resolution. It may not be such a long shot as you think. They do want to protect their image, and spend a lot of money projecting a positive one. Please give that a chance.

I'm just thinking how it is possible that a dealer "gives" you a car, which has catastrophical failure just 20 miles after you've driven off.

There's always a factor of chance, can never be ruled out, but other options aren't any better. Either they knew something was about to fail, or, and that is worse, they should have known and they didn't. Also here a factor of chance enters, but combined with bad handling and bad knowledge. You don't want these people working on any car.

It's an interesting case. What about similar cases, on technical level ? Do they exist ?

A good lawyer will get this sorted in no time and get you sorted for all the smoke that u inhaled and caused u damage.
Best of luck.
They can in the US

I bought myself a 2016 BMW 328i with 70k miles from a BMW dealership I do not wish to disclose right now. I only drove about 20-25 miles since the purchase.

first weird noises and smoke started billowing from under the hood, and before I could even process what was happening, I was covered with smoke inside of my car. when I stepped out and opened the hood there was a small fire under the engine from the oil leak. bmw mechanic said the piston broke and the engine disassembled itself along with the turbo due to lack of oil.

unfortunately, I did not buy any warranty + also the car was as is warranty.

Initially dealership offered half the repair cost of 5000$. when we disagreed, they asked us to use insurance. which was denied. Eventually they took their offer back and said its all your problem.

so can we win against them in a legal battle? what can I do in this situation. its about 15k car, with 10k repair cost. they assured us before purchasing that all maintenance was completed. How could piston brake on this car? I might have pushed the RPM maybe 1 or twice around 5–6k RPM as a test, but surely I did not redline it. I dont know what am going to do. I would much appreciate anyone who might had similar experience..

I am in florida and emon law dont apply to this car I am pretty sure.
You don't have comprehensive coverage?

Wasnt mentioned at all.. Just stated he didnt buy any Warranty!

And knowing its from a BMW dealer even if it wasnt under CERITFIED Catagory there preowned vehicles are still covered up to 250 miles...
I pulled this right off my local bmw site from a 2013 528i...

*Money-Back Guarantee is valid for 5 days or 250 miles, whichever comes first. Subject to certain terms and conditions. See store for details. Some restrictions apply. TIBBFX

Sounds like the OP may not have been at a REAL bmw dealer??

Don’t BMW dealerships sell their used cars as “Certified Pre-owned” and you get a 2 year warranty from defects? I did when I purchased from a real BMW dealership, when purchasing from a smaller lot previously it was “as-is”.

As stated above though i looked on my local dealer site and even the Pre-owned inventory not under certified still have a money back guarantee...

Sounds like this may have been a EURO dealer maybe not necessarly a authorized BMW dealer?

BMW of Gainesville. they do fraudulently misrepresent the vehicle's condition and do not disclose defects to make their sales.

maybe they didn't know... but they did inform us that vehicle is free from any major faults and fully maintenanced. yet, car breaks down within 20 miles. that's a breach of contract as it the vehicle was not free of faults and was the main reason why I have purchased this temporary vehicle.

almost no similar cases. even if there was, not in a short span of time like mine, or dealership actually fixed the problem unlike BMW of gainesville

Comprehensive does not apply to auto for warranty purposes. It is fire, theft, vandalism, if you hit animal, flood and falling objects like trees.

How were you able to drive away without full coverage insurance?

Well it did catch fire. If all else fails insurance should cover it but that would be absolutely last resort because this is on the dealer 100%.

Exactly. Which is why I asked. The OP should've had comprehensive coverage with his insurance and covered when he left the dealership.

Agree... Everytime I buy my cars even pre-owned, I call my insurance and transfer to the new one before leaving the dealer. I understand it is not legal to drive without insurance. This issue is very odd.
Would the dealer have forgotten to refill the lubricant?

Most insurance companies in the US offer a grace period when buying a car if you can show the purchase date.

I have AAA i understand i have 30 days as a Grace period..
In usa 99% of dealers make you financially responsible by providing insurance to accept responsibility of said purchase before driving off!!
That said insurance is the law and protects my investmen if ur foolish enough to use a Grace period and think you’ll be covered in that period for a major issue is just crazy to me!!
